BUSINESS PLAN TOOL PRIVACY NOTICE
Business Plan Tool is operated by Business Centric Services Group, Inc. (“BCSG”). While you have been introduced to Business Plan Tool by Wells Fargo Bank N.A. (“Wells Fargo”), Wells Fargo is acting solely as an introducer of BCSG and not as its partner, representative or agent. As such, your use of the Business Plan Tool shall be governed by an agreement between you and BCSG, not by an agreement between you and Wells Fargo. Accordingly, Wells Fargo accepts no liability relating to your use of Business Plan Tool, except for any: (i) fraud or fraudulent misrepresentation made by Wells Fargo; (ii) death or personal injury caused by the negligence of Wells Fargo and/or its employees, subcontractors and/or agents; or (iii) any other liability that cannot be excluded at law.
Please read this Privacy Notice (the “Privacy Notice”) carefully and in its entirety. This Privacy Notice is part of our websites’ terms of use (“Website Terms“) and should be read in conjunction with the Website Terms. It is an agreement between you and BCSG. You must read, accept and thereafter adhere to this Privacy Notice in order to use the Business Plan Tool.
References to “we” or “us” in the Terms refer to BCSG.
This Privacy Notice summarizes how BCSG may collect, use and distribute data and information from which you may be personally identifiable (“Personal Information”). It also explains some of the security measures BCSG takes to protect your Personal Information, and tells you certain things BCSG will do and not do.
BCSG reserves the right to change this Privacy Notice, or any other policy or practice, at any time. Except as provided in this Privacy Notice or as otherwise required by law, we may or may not provide you with notice of the changes. Therefore, we recommend that you review this Privacy Notice from time to time and that you also review the Website Terms periodically. Your use, or continued use, of the Websites will be conclusively deemed acceptance of this Privacy Notice and any changes or modifications to this Privacy Notice.
Please note that our Websites are not intended for individuals under the age of eighteen (18) (“children“). Accordingly, we will not knowingly collect or post information from children without parental or guardian consent. Moreover, we will not knowingly collect or use any personal data collected from children for any purpose whatsoever, including disclosure to any third party. Please use your best efforts to prevent children (and any other unauthorized users) from using your registration information and log-in information in order to access our Websites.
We may collect Personal Information about you from a number of sources, including the following:
1.1 From you when you register to take a service or products from us, in which case this may include your contact details and information about your business.
1.2 From you when you contact us with an inquiry or in response to a communication from us, in which case, this may tell us something about how you use our services.
1.3 From documents that are publicly accessible or that we can legally acquire from third party sources that have acquired that information in conformity with applicable laws.
1.4 Information about your system as it interacts with us such as your IP address and browser information.
We will gather some of the Personal Information that we will collect from you during an initial voluntary registration process. Although some of the Personal Information is necessary for us to deliver some of our products and services to you or to enable you to use certain features of our Websites, you are not required to submit Personal Information to us if you do not want to do so. We may not be able to provide certain products or services to you if you decline to submit required Personal Information.
In addition to the initial voluntary registration process, we may request Personal Information from you when you purchase certain Products or services on our Websites or when you complete optional survey forms or fill out optional contact forms for additional information on particular Products and services.
2.1 Personal Information about our customers is an important part of our business. We will use your Personal Information only for the following purposes and will not keep your Personal Information longer than is necessary to fulfil these purposes.
2.1.1 To help us to identify you when you contact us.
2.1.2 To deliver or allow access to the products and services you have agreed to acquire from us.
2.1.3 To help us to identify accounts, services and/or products that you have acquired from us or selected third party product providers of ours from time to time. We may do this by automatic means using a scoring system, which uses the Personal Information you have provided and/or any information we hold about you and Personal Information obtained from third party sources (including credit reference agencies).
2.1.4 To help us to administer and to contact you about improved administration of any accounts, services and products we have provided before, do provide now or will or may provide in the future.
2.1.5 To allow us to carry out marketing analysis and customer profiling (including with transactional information), conduct research, including creating statistical and testing information.
2.1.6 To help to prevent and detect fraud or loss.
2.1.7 To allow us to contact you in any way (including mail, email, telephone, visit, text or multimedia messages) about products and services offered by us and selected partners if you have elected to receive such communications.
2.1.8 To monitor and record communications with you (including phone conversations and emails) solely for quality assurance and compliance purposes.
2.1.9 We may check your details with fraud prevention agencies, in order to protect both you and us from fraud. If you provide false or inaccurate information to us, we will document and record our suspicions.
3.1 We will not sell, rent or otherwise provide your Personal Information to any third party for marketing purposes except in accordance with this Privacy Notice or otherwise upon your consent or at your request. All users of our Websites will have the ability to unsubscribe to marketing emails to which they have previously opted in by clicking on the “unsubscribe” link in e-mails sent to you
3.2 Save for Clause 3.1, the following are the only circumstances in which we may provide third parties with access to your Personal Information:
3.2.1 If our company is acquired by or merges into another company, we may transfer the Personal Information held by us about our customers to the successor company as one of the transferred assets.
3.2.2 If we have been legitimately asked to provide information for legal or regulatory purposes or as part of legal proceedings or prospective legal proceedings.
3.2.3 We employ or engage third parties to perform functions on our behalf and we may disclose your Personal Information to these parties for the purposes set out in clause 2.1 or, for example, for fulfilling orders, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links) and providing customer service. We will require that those third parties agree contractually with us to access your Personal Information solely in order to perform their functions for us and solely in a manner that comports with this Privacy Notice.
3.3 Where you give us Personal Information on behalf of someone else, you confirm that you have provided them with access to the information set out in this Privacy Notice and that they have not objected to such use of their Personal Information. You represent to us that you will not provide us with Personal Information on behalf of anyone who has not given you full and complete authority to do so.
3.4 If you provide false or inaccurate information to us and we suspect fraud, we will record this and may share it with other people and organizations. We, and other credit and insurance organisations, may also use technology to detect and prevent fraud.
We have strict security measures to protect Personal Information.
4.1 We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
4.2 We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personally identifiable customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose Personal Information to you.
4.3 It is important for you to protect against unauthorized access to your password and to your computer. Be sure to log out when you finish using a shared computer.
5.1 You acknowledge and agree that Personal Information may be used by us to provide welcome materials and/ or courtesy calls as part of an introduction to the services and to provide on-going information regarding Business Plan Tool. Certain communications form a core part of the services including information relevant to your business and tutorial material to help you make the most of the services.
5.2 If you have elected to receive promotional communications from us, we may occasionally email you about our services and Products. When you first give us Personal Information through the Websites, we will give you the opportunity to say whether you would prefer us not to contact you by email. You can also always send us an email (at the address set out below) at any time if you change your mind.
6.1 Please remember that communications over the Internet, such as emails and webmails (messages sent through a website), are not secure unless they have been encrypted. You also acknowledge that Internet based communications cannot ever be 100% secure. Your communications may go through a number of countries before they are delivered – this is the nature of the Internet. We cannot accept responsibility for any unauthorized access or loss of Personal Information that is beyond our control.
6.2 We may use ‘cookies’ to monitor how people use our Websites. This helps us understand how our customers and potential customers use the Websites so that we can develop and improve the design, layout and function of the Websites and improve our Products and services in the process. A cookie is a piece of information that is stored on your computer’s hard drive through your browser, to recognize your browser and which records how you have used a website. This means that when you go back to that website, it can give you an individually customized experience and tailored options based on the information it has stored about your prior visits. 7.1 The Website may include third-party advertising and links to other websites. We do not provide any Personal Information to these advertisers or third-party websites.
7.2 These third-party websites and advertisers, or Internet advertising companies working on their behalf, sometimes use technology to send (or “serve”) the advertisements that appear on the Website directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalise advertising content. We do not have access to or control over cookies or other features that they may use, and the information practices of these advertisers and third-party websites are not covered by this Privacy Notice. 7.3 You agree to release us from all liability for loss that you may incur when using these third party websites.

It is your responsibility to check regularly to determine whether this Privacy Notice has changed.
8.3 You can ask us for a copy of this Privacy Notice and of any amended Privacy Notice by writing to the above address or by emailing us at support@bcsg.com. This Privacy Notice applies to Personal Information we hold about individuals. It does not apply to information we hold about companies and other organisations.
8.4 If you would like access to the Personal Information that we hold about you, you can do this by emailing us at support@bcsg.com or writing to us at the address noted above. There may be a nominal charge of $10 to cover administrative costs.. If you tell us that we are holding any inaccurate Personal Information about you, we will delete it or correct it promptly.
